The Massachusetts Alliance Against Predatory Lending (MAAPL) has released a new, comprehensive Fact Sheet covering all nine of the bills they have filed for the 2017 legislative session. The Fact Sheet includes an overview of the rise in foreclosures in Massachusetts, as well as brief descriptions of each MAAPL bill.

MAAPL Introduces Anti-Foreclosure Legislation for 2017

Anti-foreclosure activists celebrate the filing of nine pieces of legislation by the Massachusetts Alliance Against Predatory Lending (MAAPL), which together offer a comprehensive resolution to the continuing rate of foreclosures, year after year, and their ever-increasing cumulative impact on the people of Massachusetts, our communities, and the Commonwealth’s entire economy.

MAAPL issued a press release on January 20th to announce the filing of their legislation. You can download a copy of the press release as a PDF file.

“Our legislators must do all they can to elevate the issue of the impact of our Massachusetts foreclosure crisis to a momentous level. MAAPL’s legislative agenda supports the needs of illegally foreclosed property owners and their long-suffering communities. We need our Senators and Representatives to sponsor and wage winning campaigns to pass these bills,” said Zakiya Alake, MAAPL board member and representing the Roxbury Neighborhood Council board. “Yet even more is needed. Foreclosed homeowners need legislators as champions to take our battle for justice to every segment of society, particularly mainstream media.”

“We cannot thank enough the legislators with vision of a just Commonwealth where the constitutional right to own your home as an inalienable right to property is honored. They have joined us in the filing of nine critical pieces of legislation. While this is a massive undertaking by MAAPL (a coalition of over 70 organizations, from grassroots groups and homeowner lawyers to the state AFL-CIO and the Northeast area conference of the NAACP), the historic undermining of fundamental constitutional rights to property and to due process in an attempted taking against one’s will of one’s home clearly demands such an aggressive, comprehensive, and vast effort,” explained Grace Ross, coordinator of MAAPL and Worcester resident. “Nothing less can be asked as the Industry is continuing its attempt to strip the 20 year rights to reverse an illegal foreclosure from Massachusetts homeowners — especially some 77,344 foreclosed in our state between 1997 and 2013.”

The bills that MAAPL and its visionary legislative leaders have filed for the 2017-2018 legislative session are:

  • Facilitating Alternatives to Foreclosure (Pre-foreclosure mediation), which ran at a 97% success rate in the city of Lynn while the program continued;
  • Establishment of a foreclosure review of the superior court to coalesce the expertise some judges in the state have been exponentially building up in this acute foreclosure crisis to address problems, both for those illegally foreclosed and those attempting to purchase a property that turns out to include an illegal foreclosure;
  • Tax debt relief, because the state, unlike the Federal government, attempts to collect taxes on the massive loss of foreclosures for impacted families;
  • Judicial foreclosure, to final provide measured judicial oversight of the potentially illegal takings of people’s homes;
  • Preventing unnecessary vacancies, (rental for homeowners is supported post-foreclosure while the ownership of the property is being sorted out);
  • Improvements to the property tax laws to finally add some consumer protections to a 1873 statute presently being used by some cities and towns, resulting in unassailable property tax foreclosures;
  • The Real Estate Title Protection Act (aka, the Mortgagee Truth and Transparency Act), which will require documents described as affidavits in the Registry of Deeds to meet the standards to be legal affidavits, require timely filing of assignments of mortgage and foreclosure deeds and require transparency to who the real mortgagee is in both the Registry of Deeds and mortgage statements to consumers;
  • The Resolution Trust Fund, to provide an alternative when the real mortgagee cannot be identified for a mortgage (true in more than 50% of cases), provides a homeowner fund where a homeowner may contribute their mortgage payments with an affordable mortgage rate.
  • Municipal Health and Safety bill, clarifying that cities and towns can continue to use their traditional powers to protect their residents, even if the health and safety threats require addressing foreclosures and their harm.

MAAPL Marches on January 21st

Anti-foreclosure Activists! WE ARE MARCHING! We are marching for women’s wealth and for a reversal of the largest economic injustice of our lives, and a sexist one at that. 

We at MAAPL join millions across the U.S. to march against a government rooted in sexism THIS SATURDAY 1/21/17 (see meet-up info below).

Our Constitution guarantees everyone a right to property and the protection of it, including women!

Please join us at the Boston Women’s March for America on Saturday, January 21st. We will be meeting up on Boston Common,* and we need your presence. We won’t have a banner, but we have lots of colorful signs and we need women to carry them and bring home the illegalities of what has happened.

We always have to remind folks that whenever any subsection of our population can have their rights discriminatorially violated, that is always a test by the folks who are doing the violating to see if they can expand the violation to everybody. So long as any of us are treated as second class citizens, everybody is eligible to have their lives destroyed.

As MLK said: a threat to justice anywhere is a threat to justice everywhere.
AND when they have struck the women, they have struck a rock!

The subprime mortgages and their resulting foreclosures were an overall attack on the wealth of women and our attempts to finally establish ourselves as head of households with the right to own a home. The industry has made it clear that women are still not supposed to have a constitutional right to property equivalent to everyone else, and we need to make it clear that is not acceptable. Folks like Trump’s appointees from the financial industry, including the CEO of the failed Indy Mac, are not going to get a walk from women for what they have done.

Almost every illegally foreclosed woman head of household whose mortgage I have been able to review includes the words “a single woman”—the gender of the borrower is supposed to be illegal to bring under consideration, without the efforts of a civil rights movement.

The banking industry is not required to specifically track gender discrimination in lending in their statistics, as they are required to track discrimination based on race. But we know that there has been massive discrimination, and we know that women heads of household were illegally targeted for subprime mortgages. Women traditionally have much better credit ratings than men, and yet statistically they held way more of the subprime mortgages.

We need your presence, we must get this story out! Please march with us in Boston tomorrow!

 *We will meet at 11am just inside the gate onto the Boston Common by the crosswalk that crosses Charles St. from the Public Gardens. Just inside there is the cement structure above the Public Garage, we will be on the State House end of that structure. Also, you can text Grace Ross at 617-291-5591. MAAPL Releases PSA About 12/30/16 Deadline to File

UPDATE: Feb. 23, 2017 is expected NEW deadline to file at the Registry of Deeds.

If your home was foreclosed on before 2014, and you want to get your home back—or receive FULL restitution—you need to file an Affidavit at your local Registry of Deeds by DECEMBER 30th, 2016. A law that went into effect last year, S.2015, cuts your 20 year constitutional rights to fight to get your home back down to only 3 years!

If you know anyone who was foreclosed on before 2014, please make sure they know about this so they don’t lose the chance to regain their home or receive restitution for the loss of their home.
